1. Introduction

Welcome to Vamos. These Terms of Service ("Terms") govern your use of the Vamos platform, accessible at vamoslocal.com. By accessing or using the platform, you agree to be bound by these Terms.

Vamos is a marketplace that connects tourists with local guides for personalized, AI-generated walking tours. The platform facilitates tour planning, booking, payment processing, and communication between tourists and guides.

The platform also provides hotel pickup services, optional donation capabilities, newsletter communications, a travel guide blog, and tools for guides to suggest new tour stops.

2. Account & Authentication

2.1. Vamos uses Google OAuth for authentication. By signing in, you authorize us to access your basic Google profile information (name, email, and profile photo) for account creation and identification purposes.

2.2. You are responsible for maintaining the security of your Google account. Any activity under your Vamos account is your responsibility.

2.3. You agree to provide accurate information and to keep your profile up-to-date. Misrepresentation of identity or credentials may result in account suspension.

3. Privacy & Data

3.1. We collect the following information: your Google profile data (name, email, photo), tour preferences and questionnaire responses, booking history, payment transaction records, and messages sent through the guide chat.

3.2. Your data is used to generate personalized itineraries, process bookings and payments, match you with suitable guides, and improve the platform experience.

3.3. We do not sell your personal data to third parties. Payment information is processed securely through Stripe and is never stored on our servers.

3.4. You may request deletion of your account and associated data by contacting us. Note that transaction records may be retained for legal and financial compliance purposes.

4. Booking & Payment Terms

This section applies to tourists booking tours on Vamos.

4.1. Vamos offers three payment methods: credit/debit card (via Stripe), Bitcoin (via Lightning Network), and Pay During Tour (cash or direct payment to your guide at the start of the tour).

4.2. Pay During Tour: If you select this option, you commit to paying your guide the full amount shown at booking time when the tour begins. The amount due is exactly what was displayed during checkout. Failure to pay may result in tour cancellation and account restrictions.

Platform Fee

A 20% platform fee is included in the total price displayed at checkout. This fee covers AI itinerary generation, platform maintenance, payment processing, and customer support.

Reimbursement Fee

In the event of a refund, the platform fee is 0% on reimbursements. You will receive a full refund of the eligible amount with no platform deductions on the refunded portion.

4.3. All prices are displayed in the local currency. The final price depends on tour duration, group size, and any applicable surcharges. Price breakdowns are shown transparently before payment.

4.4. Hotel Pickup Service: Tourists may opt for hotel pickup at a rate of $1 per estimated minute of pickup time. The pickup fee is calculated based on the estimated duration selected at checkout and is non-refundable once the guide has departed for the pickup location.

4.5. Donations: Tourists may optionally add a donation during checkout. Donations are voluntary, non-refundable, and support the ongoing development of the Vamos platform.

4.6. Shareable Itineraries: Booked itineraries can be shared via a public link. Shared pages display the tour stops and route information only — no personal or payment data is included in shared views.

5.1. Cancellation requests must be made through the platform. The refund amount is determined by how far in advance the cancellation is made relative to the scheduled tour date and time.

5.2. Refunds for card payments are processed back to the original payment method. Bitcoin payment refunds are issued at the original transaction value in the payment currency.

5.3. If a guide cancels or fails to appear, you are entitled to a full refund regardless of the cancellation window.

6. Tourist Conduct

6.1. You agree to arrive at the designated meeting point on time. Late arrivals may result in a shortened tour with no refund for missed time.

6.2. You must treat your guide and fellow tour members with respect. Abusive, threatening, or discriminatory behavior will result in immediate tour termination and account suspension.

6.3. You are responsible for your personal safety and belongings during the tour. Follow your guide's safety instructions at all times.

7. Guide Terms & Responsibilities

This section applies to guides registered on the Vamos platform.

Platform Commission

Vamos retains a 20% commission on all completed tours. For card and Bitcoin payments, the platform remits 80% of the transaction to the guide. For Pay During Tour bookings, the guide collects the full amount from the tourist and owes 20% to the platform.

Commission on Cancellations

0% commission is charged on refunded or cancelled tours. If a tour is cancelled and the tourist is refunded, no commission is deducted.

7.1. Punctuality: Guides must arrive at the meeting point at least 10 minutes before the scheduled tour start time. Repeated tardiness or no-shows may result in account suspension.

7.2. Professionalism: Guides must conduct tours in a professional manner, providing accurate information about locations and cultural context. Guides must not engage in unauthorized commercial activities during tours.

7.3. Safety: Guides are responsible for the reasonable safety of their tour group. This includes choosing safe routes, providing safety advisories, and having an emergency plan.

7.4. Availability: Guides must honor their posted availability schedule. If you need to block dates or change your availability, update your schedule at least 24 hours in advance. Accepting a booking constitutes a commitment to lead that tour.

7.5. Profile Accuracy: All profile information — including languages spoken, specialties, and neighborhoods covered — must be accurate and current. Misrepresentation may lead to removal from the platform.

7.6. Payment Collection (Pay During Tour): When a tourist selects Pay During Tour, the guide collects the full booking amount at the start of the tour. The guide is responsible for remitting the 20% platform commission as agreed.

7.7. Payment Remittance (Card/Bitcoin): For card and Bitcoin payments, the platform processes the payment and remits 80% of the transaction amount to the guide according to the payout schedule.

7.8. Stop Suggestions: Guides may suggest new stops for the catalog. Suggested stops are reviewed by the Vamos team and may be approved, modified, or rejected at our sole discretion. Approved stops become part of the public catalog. By submitting a stop suggestion, you grant Vamos a perpetual, royalty-free license to use the submitted content (name, description, images) in the platform.

7.9. Notifications: Guides receive email and in-app notifications for booking assignments, tour reminders, and stop approval decisions. You may manage your notification preferences through the guide portal. Transactional notifications related to active bookings cannot be fully disabled.

8. Dispute Resolution

8.1. In the event of a dispute between a tourist and a guide, both parties should first attempt to resolve the matter through the platform's chat system.

8.2. If a resolution cannot be reached, either party may escalate the dispute to Vamos support. Vamos will review the case and make a binding determination within 7 business days.

8.3. Vamos reserves the right to issue refunds, suspend accounts, or take other corrective action as it deems appropriate to resolve disputes fairly.

9. Limitation of Liability

9.1. Vamos acts as a marketplace connecting tourists with independent guides. We do not employ guides and are not liable for their conduct, the quality of tours, or any incidents that occur during tours.

9.2. AI-generated itineraries are provided as suggestions. Actual tour experiences may vary based on conditions such as weather, venue availability, and local events.

9.3. To the maximum extent permitted by law, Vamos's total liability is limited to the amount you paid for the specific booking in question.

10. User-Generated Content

10.1. Articles & Comments: The Vamos travel guides section features articles and allows comments. By posting a comment, you grant Vamos a non-exclusive, royalty-free license to display your content on the platform. Comments are moderated and may be removed if they violate community standards.

10.2. Feedback: Feedback submitted through the platform is used to improve our services. By submitting feedback, you acknowledge that your suggestions may be implemented without compensation or attribution.

10.3. You retain ownership of content you create but grant Vamos the right to use, display, and distribute it in connection with the platform's services.

11. Newsletter & Communications

11.1. By subscribing to the Vamos newsletter, you consent to receive periodic emails about travel tips, new destinations, platform updates, and promotional offers.

11.2. You can unsubscribe from the newsletter at any time by clicking the unsubscribe link in any newsletter email or by contacting us.

11.3. Transactional emails (booking confirmations, guide notifications, password resets) are not marketing communications and will continue to be sent as necessary for platform operation regardless of newsletter preferences.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform. Your continued use of Vamos after changes are posted constitutes acceptance of the updated Terms.
